Executors have several different duties to discharge when administering an estate. They are legally responsible for collecting the assets of the estate, paying all liabilities (including tax), and correctly distributing the estate. An executor can be held personally liable for the value of the assets in the estate if they distribute them without taking sufficient account of all such liabilities, thereby making an over-distribution to the beneficiaries. It is therefore extremely important to get it right!

Administering an estate can be complex and it is recommended that you instruct a probate solicitor, especially if any of the following apply:

  • The estate is over the Inheritance Tax threshold (£325,000 in 2022-23);
  • There are doubts over the validity of the will;
  • There is no will;
  • Persons reasonably believing they would inherit under the will have been excluded;
  • There are trusts;
  • The estate is insolvent;
  • The estate includes foreign property;
  • The deceased was domiciled outside of the UK for tax purposes.
